Incapacity Leave and Ill-health Retirement Management
Incapacity Leave
The leave dispensation as determined in the Leave Determination, read with the applicable collective agreements, provides for normal sick leave of 36 working days in a sick leave cycle of three years. If an employee has exhausted his/her normal sick leave, the Employer, may at his/her discretion grant additional incapacity leave (temporary or permanent).
The Employer must investigate the nature and extent of the employee’s incapacity, in accordance with item 10(1) of Schedule 8 of the Labour Relations Act.
Ill-health retirement
The Employer may consider the discharge of an employee on account of ill-health, based on medical evidence and in terms of the applicable employment legislation.
